Along Indian Hills Road, the turnpike moves from plans to courtrooms

NORMAN — The Oklahoma Turnpike Authority has started taking land along Indian Hills Road for the Toby Keith Expressway. Since December 2025 it has been a party in 34 Cleveland County District Court cases, nearly all of them condemnation suits it filed, and construction of the I-35/Indian Hills interchange is set to begin in spring 2027.

The roughly 28-mile toll road, formerly called the East-West Connector, will run from I-44 near Newcastle across the South Canadian River, then east along the Indian Hills corridor to I-40. OTA puts the cost at about $3 billion, with full opening in 2033. [1] It is one piece of ACCESS Oklahoma, OTA's 15-year, $8.2 billion expansion plan announced in February 2022. [2]

Who is being displaced

OTA has not published a home count for the Indian Hills stretch. These are the published figures:

  • Toby Keith Expressway, all segments: 101 properties purchased and 102 under negotiation as of June 2026. [17] A later city update listed 118 closed and 124 active. [2]
  • First segment: 40 properties, 4 of them with homes. [18]
  • 36th Ave NW: the city said a waterline easement could have cost at least two homes in the Crystal Springs addition. [12]
  • HeyDay Entertainment: OTA paid $20,533,040 for about 3.16 acres near the future I-35 junction. The county valued the property at more than $2.5M, and the business closed. [19]
  • South Extension, which branches south from the expressway between 48th and 60th Ave: about 75 homes to be acquired [7], with 29 total-take offers made and 22 properties secured as of Sept 2026. [16]

The court cases name individuals, family trusts, life tenants and several LLCs. The parcels in them range from under an acre to 12.8 acres. [15]

What owners have said

  • "We're not comfortable with it," Norman resident Marianne Beauchamp told FOX 25 after getting a survey-access letter. "My husband and I are both 80. ... it's a big worry." [6]
  • "I've lived here 64 years," Jean Hopkins told KOCO after the South Extension route was finalized. "I will not be able to survive this man-made disaster." [20]
  • "My childhood home. It's not just a house," Teresa Elam said in the same story. [20]
  • JaNelle Rutledge, describing OTA's first offer to KGOU: "maybe we could have moved the chicken house for that much money, cuz it was so little." [21]
  • Mayor Stephen Tyler Holman: "People are going to lose their homes if this project continues to move east." [12]

OTA has called condemnation "an action of last resort." [18] "It does not stop negotiations," said Todd Gore, OTA's right-of-way director. "We will continue to negotiate and always try to settle with landowners." [13]

Is the compensation fair?

  • The legal process: OTA's petitions say it negotiated in good faith and that the owners refused to sell or could not deliver clear title. Each petition asks the court to appoint three disinterested Cleveland County landowners as commissioners to set the damages. Owners are entitled to "just compensation … including any and all relocation benefits." [15] At least three commissioners' awards have been paid out so far: $447,000, $135,000 (to the state Land Office) and about $131,100, per Cleveland County court dockets. [27]
  • A past example: in the Brewer case on the Kickapoo Turnpike, OTA offered $1.3M, the commissioners awarded $1.1M and OTA's final offer was $1.5M. A jury awarded $2.97M. [22] The family's law firm says OTA's initial offer was $826K, while OTA says that figure was an expert's testimony. [23]
  • OTA's position: OTA released data in Sept 2025 that it said showed some owners who went to court received less than the original offer. The full figures are behind a paywall and were not reviewed. [24]
  • Settlements: OTA has said about 95% of owners settle. In 2022, two early sellers got more than $103K and more than $116K above OTA's first offers. [25]
  • Relocation: OTA says it pays moving costs. No ACCESS-specific relocation dollar amounts have been published.

What's next

  • A federal judge has OTA's and the federal agencies' motions to dismiss Pike Off OTA's environmental suit (W.D. Okla. 5:26-cv-01526). [14]
  • Commissioners' reports in the Cleveland County cases.
  • South Extension 60% plans in November.
  • Interchange construction in spring 2027.

Questions for OTA

  • How many homes will be taken along Indian Hills Rd?
  • How do offers compare with appraisals?
  • How many owners have rejected offers so far?

Correction, Oct 31, 2026: An earlier version of this story said no commissioners' awards had been made in the 2026 cases. Cleveland County dockets show at least three awards have been paid out.
